Macomb County District Courts

The Macomb County District Courts found within Macomb County, Michigan handle and oversee all misdemeanor crimes committed within its respective towns and municipalities from arraignment to sentencing; however, felonies will be governed by the Macomb County Circuit Court. Misdemeanors are crimes punishable by one year in the county jail and/or fines up to $1,000.00. Suppose the case is a felony, on the other hand. In that case, the specific Macomb County District Court overseeing the matter will initially determine the bond and handle the preliminary exam (or probable cause hearing). If the case is bound over, satisfying probable cause, the Macomb County Circuit Court will handle the remaining hearings for the criminal matter. The individual Macomb County District Court will be determined where the individual criminal act was committed. For example, the Warren, Macomb County District Court will handle matters committed within the City of Warren, Michigan.

A pretrial is usually the second hearing set at a Macomb County District Court if the individual enters a plea of not guilty or stands mute while attending the Macomb County District Court arraignment. At the pretrial hearing, the defendant or the defendant’s lawyer will meet with the prosecutor to discuss the charges and begin negotiations if a plea is being sought or offered. The defendant or defendant’s lawyer will also determine whether motions will be filed, obtain any remaining discovery from the State (or Prosecutor), set the matter for Jury Trial, and handle any other various pretrial issues required for the particular case while it is pending within the Macomb County District Court.

If a plea is taken or an individual is convicted, then sentencing will be scheduled at the Macomb County District Court. However, the Macomb County District Court will not always schedule a sentencing hearing on a different day unless the Macomb County District Court is required too under the statute. At the time of Sentencing, the Macomb County District Court judge can and will render a sentence that can include, but is not limited to, fines and costs, probation, jail time (county or prison), driver’s license sanctions, and responsibility fees, counseling, or other mandatory obligations imposed by the judge or probation department.
