Metro Detroit District Court – The Misdemeanor Process
The arraignment is the first court hearing in any criminal case within a Metro Detroit District Court, whether you are arrested or provided a criminal citation. The individual will enter a plea (of guilty, not guilty, or he will stand mute), and then the bond will be determined and set, which can vary depending upon numerous factors. When forming a bond, the court wants to ensure that you return for future hearings and that the community is safe—the two most important factors for a bond.
A pretrial is usually the second hearing set at a Metro Detroit District Court if the individual enters a plea of not guilty or stands mute at the arraignment. The defendant or defendant’s attorney will meet with the prosecutor to discuss the charges and begin negotiations if a plea is being sought or offered. defendant or defendant’s attorney will also determine whether motions will be filed, obtain any remaining discovery from the State, set the matter for Jury Trial, and handle any other pretrial issues required for the particular case.
Suppose a plea is taken or an individual is convicted. In that case, sentencing will ensue at the Metro Detroit District Court, which can occur the same day as the plea or trial, or it can be set to a later date—all of this is dependent upon the court’s procedure, individual’s case, and statute used in the particular case. The judge issues the order of the sentence. It will depend upon numerous factors, including but not limited to the probation recommendation, substance abuse history, facts and circumstances of the case, prior criminal history, employment status, etc. Sentencing can include but is not limited to, fines and costs, probation, jail time (county or prison), driver’s license sanctions and responsibility fees, counseling, or other mandatory obligations imposed by the judge or probation department.
